Nullification: The Rightful Remedy

The idea of nullification is simple: If the federal government passes a law or the President signs an Executive Order that is unconstitutional, the law or order is null and void and should be ignored.

In the original draft of the Kentucky Resolutions, Thomas Jefferson rested his case for nullification on the Tenth Amendment, calling federal assumption of undelgated power “unauthoritative, void, and of no force.” He declared nullification "THE RIGHTFUL REMEDY” to deal with federal violations of the Constitution.

He wrote: “Where powers are assumed which have not been delegated, a nullification of the act is THE RIGHTFUL REMEDY: that every State has a natural right in cases not within the compact, to nullify of their own authority all assumptions of power by others within their limits that without this right, they would be under the dominion, absolute and unlimited, of whosoever might exercise this right of judgment for them.”

Because the federal government is not going to limit itself, the states are duty-bound to resist.

Never forget that the states created the federal government. The states are the principles; while the federal government is the agent. Or, if you prefer, the states are the employer and the federal government is the employee! And employment is "at will!"
